NFL players will soon get a new way to protest, and a union is asking them to keep it.
The National Football League Players Association (NFLPA) is asking the National Labor Relations Board to overturn a decision by the NLRB last month to strike.
The union argued that the NLRA should allow workers to file a collective bargaining agreement without the need for the union to get the NLRPA’s approval.
“It’s time to strike back,” NFLPA president DeMaurice Smith told the Associated Press, referring to a new law passed in 2018 by the U.S. House and Senate that prevents unions from striking unless a collective-bargaining agreement with the National Football Association (NFA) is in place.
“That law has been in place for years, and it has been clear that we are willing to stand up for workers and not allow them to be treated like a bargaining chip for the NFL.”
The NLRB’s decision in March to strike struck down a longstanding provision in the NLA that bars unions from using their power to bargain collectively.
The NLRB found that the NFA’s collective bargaining agreements with other NFL teams did not comply with the terms of the collective-protection statute.
The NLRRB sided with the NFL in a court ruling, ruling that the rule of law had been violated by the NFL’s unilateral strikes.
“We are concerned that the NFLPA’s argument that it was entitled to unilateral unilateral strike power is incorrect,” the NLRLB said in a letter to the NFL last month.
“The NFLPA has been negotiating in good faith with the NLERP for a long time, and its recent unilateral strike actions are consistent with that,” the union said.
“However, the league and the NLLEO failed to communicate the union’s positions to us about their position and to provide us with a list of specific bargaining demands.”
“We do not believe that the union has a right to unilaterally strike, particularly given that it is an unelected body of elected officials who are not subject to the same legal and ethical standards as elected officials.”
Smith said the NFL is not satisfied with the court’s ruling.
“There are plenty of people who agree with the NRA and the NFL that are not happy with the rule,” he said.
The NFL was able to strike during the NFL season in 2017, when the league lost its playoff series against the Cleveland Browns.
NFL players staged a nationwide walkout that lasted three days.
“This is a clear example of the collusion that has been happening between the NFL and the NLEO,” Smith said.
If they don’t, the NLA will take action against the NFL,” he added. “
It is our hope that the court will take the position that the only way to ensure that this doesn’t happen again is for the league to negotiate directly with the union.”

The new law does not apply to employees of the NFL, the NFL team owners, the team owners’ representatives or any players.
NFL Commissioner Roger Goodell told reporters on Tuesday that he would review the NLRR’s decision and will decide by the end of this month whether to appeal.
The league is currently negotiating with the NHL’s owners for a new collective bargaining deal.
“At this point, we’re looking at our options, we are making some changes and we’re hoping that the courts will give us the flexibility that we need to make this right,” Goodell said.
A spokesperson for the NBLRB did not immediately respond to a request for comment.
Smith has been a leader in the fight for workers’ rights in the AFL, but he is the first NFL leader to call for a strike in protest of the NLHR decision.
“What we are asking for is to get our message across, and not be afraid to take it to the NLBO,” Smith told reporters last month in an interview with ABC News.
